What is a Muniment of Title
Muniment of title is a simplified version of probate where an executor is not named, instead the beneficiary gets a court order that directs companies who hold assets in the name of the deceased person to turn over those assets to the beneficiary. They are good where the following are true:
-
No debt other than a mortgage
-
Clear beneficiaries and not that many
-
No MediCAID (not Medicare) used during the deceased’s lifetime
-
No need for a tax ID for the estate
-
No complex asset mix
If there is a 401k in the mix, then you typically need a tax ID in order for the 401k company to withhold taxes. Check with the company on what they will accept.
You can run into problems with out-of-state banks not understanding the procedure and court order, there may be assets later discovered that are not easily transferred, or there may be times the estate needs a representative like in a lawsuit. If any of those things happen, you would have to go back to court to convert the muniment of title to an independent administration.
